PARTIES
This Agreement is entered into between:
- Buyer (named above)
- Diamocycle Marketplace (“Diamocycle”), a division of Diamocycle Inc., with principal place of business at 12058 198th Ave SE, Issaquah, WA 98027
1. ESCROW VIA ESCROW.COM
1.1 The full purchase price {sale_price} is held in escrow by Escrow.com, an independent third-party escrow provider.
1.2 Diamocycle is not a party to the escrow account and has no control over funds once deposited.
1.3 Diamocycle is not liable for any technical, processing, payment, or dispute-resolution delays caused by Escrow.com.
1.4 Funds are released per Escrow.com’s standard terms and the timeline in Section 4 below.
2. VERIFICATION PROCESS
2.1 Seller must ship the item to Diamocycle’s Verification Center by the end of the next two business days {insert_date} using the provided Free & Insured Shipping Label.
2.2 Diamocycle uses an independent third-party gemological laboratory (not affiliated with Diamocycle) to verify the item matches the listing description.
2.3 Diamocycle is not liable for lab errors but will facilitate re-inspection or dispute resolution through Escrow.com.
3. SHIPPING & DELIVERY
3.1 After verification, Diamocycle ships the item to the Buyer via insured, trackable carrier.
3.2 Estimated delivery: 3-5 days after verification.
3.3 Risk of loss transfers to Buyer upon delivery.
4. BUYER VERIFICATION & RETURN PERIOD (Escrow.com Standard)
4.1 You receive the item → Day 0
4.2 You have 3 calendar DAYS from delivery to inspect and report “not as described” to Escrow.com (CC: info@diamocycle.com).
4.3 If you report a discrepancy:
- Return item free of charge (prepaid label provided)
- Item is sent back to the same independent lab at Diamocycle’s cost
- Lab confirms = original verified item → claim denied; funds released to seller
- Lab confirms mismatch → full refund issued to you 4.4 Seller is paid within 14 calendar days of your delivery (or resolution of any valid claim) via bank check mailed to verified address or printable PDF check.
5. FRAUD & DISPUTE POLICY
5.1 Diamocycle implements anti-fraud measures (pre-shipment video, lab verification, return-to-lab checks) to protect both Buyer and Seller equally.
5.2 Diamocycle is not liable for fraudulent acts by either party.
5.3 All disputes must be filed and resolved exclusively through Escrow.com’s official dispute process.
5.4 Buyer and Seller agree to cooperate fully with Escrow.com and Diamocycle investigations.
7. GOVERNING LAW
This Agreement is governed by the laws of Washington State. Any disputes not resolved via Escrow.com shall be subject to binding arbitration.
8. ACCEPTANCE
By signing below, Buyer acknowledges:
- Full understanding of escrow, verification, 3-day return window, and fraud policies
- Agreement to all terms above
